Obtaining Rational, Efficient, and Cost-Effective Solutions through Mediation

A Skilled Dallas Mediator with 15 Years of Mediation Experience

At the Law Office of Brenda Hull Thompson, we focus our legal services on helping clients find real solutions to their legal issues. Sometimes litigation is the only option, but often mediation can often provide a more satisfactory resolution, privately and cost-effectively.

Almost any dispute can benefit from mediation. Even if you doubt that your dispute can be resolved in this way, it is worth your time to make the attempt in any situation when the parties are willing to participate, are capable of participating, and can be trusted.

As a fully trained mediator with more than 15 years of experience, Dallas attorney-mediator Brenda Hull Thompson mediated cases in diverse general civil law areas  such as family, probate, contracts, personal injury and wrongful death, deceptive trade practices, property, employment discrimination and wrongful discharge, workers' compensation and debt collection.

Attorney Thompson taught mediation at Texas Wesleyan University for many years. She served as a panelist for the U.S. Arbitration and Mediation Service and participated in the Harvard University Law School Negotiation Program. She has been providing comprehensive mediation services since 1989. She has completed mediation training, coursework in collaborative family law, and focused training in mediation of family law and Child Protective Services cases.

The Benefits of Mediation

The bottom-line reason to seek a lawyer is to find a successful resolution to your legal problem. Mediation offers many benefits as you resolve your dispute that litigation cannot:

  • It is cost-effective—usually far less expensive than a trial
  • It allows the parties involved to control the outcome and resolution, unlike in litigation where a judge or jury controls the outcome
  • It allows the parties to explore options and address issues that cannot be addressed in court
  • It typically does less damage to the relationship of the two parties in the mediation; in fact, it can actually improve communication between the two parties
  • It is private and confidential, not part of the public record

Examples of Mediation in Resolving Disputes

Business Mediation: Business people involved in a legal dispute have a far greater understanding of the business issues involved in their case than a judge or jury. The parties are often able to reach creative business solutions that a jury would not have considered. Their businesses are spared protracted conflict and can minimize their exposure to liability.

Family Law Mediation: Parents are often better able to craft visitation schedules and arrive at financial agreements that meet the needs of their unique family situation when they work together outside of court. Mediation can also help build a good working relationship between parents, while litigation can often break that relationship—which you will need as you co-parent—down.

Employment Law Mediation:  Sometimes mediation allows the party who has been in the wrong to change course while also saving face. Mediation can be helpful in preventing a difficult situation from escalating. Additionally, resolutions obtained through mediation can be kept altogether confidential. Not even the fact that a settlement has been reached need be revealed.

Mediation when Contesting a Will or Probating an Estate: We have mediated probate cases in which heirs contested a will, and in intestate situations where there was no will and potential heirs were disputing the distribution of property. Whenever disputes arise among family members, mediation can be an advantage. Parties find results they can agree upon, and relationships can be preserved. Also, litigation takes a big bite out of the money left in the estate.
